Utilization of the services by the Customer following the effective date on their paid invoice shall constitute acceptance by the Customer of this Web Services Agreement. Due to our evolving business, and the ever-changing nature of the web hosting industry, terms of this Web Services Agreement may change from time to time. Customer is solely responsible for staying informed with respect to these changes. We will post all changes here. Your continued use of our services constitutes your understanding and acceptance to this agreement and any changes made thereafter.

Omega Technology Group, Inc. Web Services Agreement

1) Web Services provided by Omega Technology Group, Inc. includes, but is not limited to: Website Hosting Services, E-mail Hosting Services, Domain Services, Hosted DNS Services, IDX Services, Hosted Database Services and Web Development Services.

2) All services may be used for lawful purposes only. You agree to indemnify and hold OMEGA TECHNOLOGY GROUP, INC. harmless from any claims resulting from your use of our service that damages you or any other party.

3) You expressly understand and agree that OMEGA TECHNOLOGY GROUP, INC. shall not be liable to you or any third party for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, business, revenue, goodwill or anticipated savings, loss of wages, the cost of procurement of substitute goods and services, loss of employees, loss of employment, loss of use, loss of data, loss of email or other intangible losses resulting from the use or the inability to use the services provided by Omega Technology Group, Inc., or for any other indirect, incidental or consequential loss or special damages arising out of the operation of or inability to operate any services provided by Omega Technology Group, Inc.

4) All services are provided on as AS-IS and AS-AVAILABLE basis. Other than as expressly set out herein, we have not and do not make any warranties whether expressed or implied. This disclaimer includes, but is not limited to the warranties of non-infringement, fitness for a particular purpose, warranties or merchantability, and title.

5) While Omega Technology Group, Inc. makes every effort to provide the best Website Services to our Clients, there may be some circumstances that are beyond our control, therefore we provide no guarantee that the services will be uninterrupted, secure or continuous, nor that you will be able to access our services at a particular time. We do not warranty that any data transmitted by, or through us is accurate or reliable, error free, free from viruses or other harmful components, or inoffensive. We are also not responsible for delivery failures caused by Omega Technology Group, Inc. or any operation of a third party. Email accounts are not designed to function as permanent storage. We assume no responsibility for email files that are lost, delayed, bounced back to sender, damaged or inadvertently deleted.

6) You acknowledge that it is your responsibility to keep back-up copies of all your data associated with this account. We are not responsible for any loss of data, for any reason. We are not liable for unauthorized access to, or any corruption, erasure, theft, destruction, alteration or inadvertent disclosure of, data, information or content that has been transmitted, received, or stored on our system.

7) You will not employ programs that consume excessive system resources, including but not limited to processor cycles and memory. Servers are shared with other customers and as such IRC-related activities or severely CPU intensive CGI scripts (e.g. chat scripts) are prohibited. Any application that listens for inbound network connections (even if the application would otherwise be allowed) are not permitted. BitTorrent clients, proxy servers/scripts, IRC bots and bouncers (BNC) specifically may not be run on any Omega Technology Group, Inc. hosting server. If your processes are adversely affecting server performance disproportionately we reserve the right to negotiate additional charges with you and/or discontinue the offending processes.

8) We are not liable and expressly disclaim any liability for the content of any data transferred either to or from you or stored by you or any of your customers via the services provided by us. We specifically disclaim, and all warranties regarding services provided by third parties, whether those services appear to be provided by us. No warranties made by these third party entities to us shall be passed through to you, nor shall you claim to be a third party beneficiary of such warranties.

9) You are restricted to the data storage, number of domain names, and bandwidth quota applicable to your specific web hosting package. Additional storage and bandwidth usage will be charged at current published prices.

10) Omega Technology Group, Inc. reserves the right to restrict the numbers of electronic emails you can send from your account without notice.

11) This warranty disclaimer extends to any oral or written information you may have received from us, our employees, or third-party vendors.

12) Changes to our Web Services Agreement: If we decide to change our Web Services Agreement, we will post those changes on this page, and/or update the Web Services Agreement modification date below.
